MADDE 1 – TARAFLAR

www.lapluiejewellery.com internet sitesi üzerinden sipariş veren kişi.

 

MADDE 2 – SÖZLEŞMENİN KONUSU

 

İşbu sözleşmenin konusu, ALICI'nın SATICI'ya ait internet sitesi üzerinden elektronik ortamda sipariş verdiği ürün/ürünlerin satışı ve teslimine ilişkin olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerinin belirlenmesidir.

 

MADDE 3 – ÜRÜN BİLGİLERİ

 

Ürün adı, adedi, satış bedeli, kargo ücreti ve ödeme şekli sipariş özetinde belirtildiği gibidir.

Tüm fiyatlara KDV dahildir.

 

MADDE 4 – TESLİMAT

 

4.1 Ürünler, sipariş onayından itibaren 3–5 iş günü içerisinde kargoya verilir.

4.2 Türkiye içi gönderimler ücretsizdir.

4.3 Teslimatlar DHL Kargo aracılığıyla yapılmaktadır.

4.4 Yasal azami teslim süresi 30 gündür.

4.5 Mücbir sebepler (doğal afet, grev, sistem arızası vb.) halinde teslim süresi uzayabilir.

 

MADDE 5 – ÖDEME

 

Ödeme;

  • iyzico altyapısı üzerinden kredi kartı/banka kartı
  • Banka havalesi (IBAN)

yöntemleri ile yapılabilir.

Ödeme tamamlanmadan sipariş işleme alınmaz.

 

MADDE 6 – CAYMA HAKKI

 

6.1 ALICI, ürünü teslim aldığı tarihten itibaren 14 gün içinde herhangi bir gerekçe göstermeksizin cayma hakkına sahiptir.

6.2 Cayma hakkının kullanılabilmesi için ürünün:

  • Kullanılmamış olması
  • Hasarsız olması
  • Orijinal ambalajında eksiksiz bulunması

gerekmektedir.

6.3 Cayma hakkı kapsamında iade kargo ücreti ALICI'ya aittir.

6.4 İade edilen ürün SATICI'ya ulaştıktan sonra bedel en geç 14 gün içerisinde ALICI'ya iade edilir.

 

MADDE 7 – CAYMA HAKKININ KULLANILAMAYACAĞI HALLER

 

Mesafeli Sözleşmeler Yönetmeliği madde 15 uyarınca:

  • Hijyen sebebiyle kullanılmış veya denenmiş küpeler
  • Tüketicinin özel talebi doğrultusunda hazırlanan ürünler (kişiye özel üretim, ölçüye göre tasarım vb.)
  • Ambalajı açılmış ve yeniden satılabilirliğini yitirmiş ürünler

iade kapsamında değildir.

 

MADDE 8 – AYIPLI MAL

 

Ürün ayıplı ise ALICI, 6502 sayılı Kanun kapsamında seçimlik haklarını kullanabilir:

  • Ücretsiz onarım
  • Değişim
  • Bedel iadesi
  • Ayıp oranında indirim

Ayıplı ürünlerde iade kargo ücreti SATICI'ya aittir.

 

MADDE 9 – UYUŞMAZLIK

 

Uyuşmazlıklarda, ALICI'nın yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.

 

ALICI, siparişi onaylayarak işbu sözleşmeyi kabul etmiş sayılır.

ARTICLE 1 – PARTIES

BUYER:


The person placing an order via the website www.lapluiejewellery.com.

 

 

 

ARTICLE 2 – SUBJECT OF THE AGREEMENT

 


The subject of this Agreement is to determine the rights and obligations of the parties in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product(s) ordered electronically by the BUYER through the SELLER’s website.

 

 

 

ARTICLE 3 – PRODUCT INFORMATION

 


The product name, quantity, sales price, shipping fee and payment method are as specified in the order summary.


All prices include VAT.

 

 

 

ARTICLE 4 – DELIVERY

 


4.1 Products shall be dispatched within 3–5 business days following order confirmation.


4.2 Domestic shipping within Turkey is free of charge.


4.3 Deliveries are made via DHL Cargo.


4.4 The maximum legal delivery period is 30 days.


4.5 Delivery time may be extended in cases of force majeure (natural disasters, strikes, system failures, etc.).

 

 

 

ARTICLE 5 – PAYMENT

 


Payment may be made via:

 

  • Credit/debit card through the iyzico payment infrastructure

  • Bank transfer (IBAN)

 


Orders shall not be processed until payment is completed.

 

 

 

ARTICLE 6 – RIGHT OF WITHDRAWAL

 


6.1 The BUYER has the right to withdraw from the contract within 14 days from the date of receipt of the product, without providing any reason.


6.2 In order to exercise the right of withdrawal, the product must be:

 

  • Unused

  • Undamaged

  • Complete and in its original packaging

 


6.3 The return shipping cost under the right of withdrawal shall be borne by the BUYER.


6.4 Once the returned product is received by the SELLER, the payment shall be refunded to the BUYER within 14 days at the latest.

 

 

 

ARTICLE 7 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

 


Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal shall not apply to:

 

  • Earrings that have been tried on or used for hygiene reasons

  • Products prepared in accordance with the consumer’s special request (custom-made, made-to-measure designs, etc.)

  • Products whose packaging has been opened and which are no longer suitable for resale

 

 

 

 

ARTICLE 8 – DEFECTIVE GOODS

 


If the product is defective, the BUYER may exercise their optional rights under Law No. 6502:

 

  • Free repair

  • Replacement

  • Refund

  • Price reduction proportionate to the defect

 


In cases of defective goods, the return shipping cost shall be borne by the SELLER.

 

 

 

ARTICLE 9 – DISPUTE RESOLUTION

 


In the event of disputes, Consumer Arbitration Committees and Consumer Courts at the BUYER’s place of residence shall have jurisdiction.

 

 

By confirming the order, the BUYER shall be deemed to have accepted this Agreement.
